PCR1996047AMENDED RESOLUTION #P.C. 47-96 APPROVAL OF A CONDITIONAL USE GRANT TO ALLOW FOR USED CAR SALES FOR JACOB FREY FOR THE PROPERTY LOCATED AT S107 W16311 LOOMIS ROAD (Old Loomis Sport Shack) WHEREAS, The Plan Commission at their meeting of February 6, 1996, in discussing Resolution #P.C. 24-96 determined that a Public Hearing should be held, and WHEREAS, The Public Hearing has been held, and WHEREAS, The property is zoned B-4, Highway Business District and used auto sales are permitted as a conditional use, and WHEREAS, Plans were submitted on February 19, 1996 requesting approval of an amended Building, Site and Operation Plan to allow used car sales, and WHEREAS, The petitioner is proposing to use the existing three bay garages, one storage room, work shop area and office, and WHEREAS, The indoor space is to be used for the preparation of vehicles for sale, and WHEREAS, Vehicle display will be limited to 24 vehicles with accurate right of ways for all, the first row of vehicles starts fifty-five feet from the center line of old Loomis Road, and WHEREAS, It is proposed to use the two existing roof signs along with an individual lettered sign, and WHEREAS, It is proposed to be strictly auto sales, and WHEREAS, The existing exterior lighting will be ample at this time, and WHEREAS, The hours of operation will be from 9:00 a.m. to 9 p.m. Monday thru Saturday. THEREFORE BE IT RESOLVED, That the Plan Commission approves of the amended Building, Site and Operation Plan dated (received 02-19-96 and said plan be kept on file in the Building Department along with any subsequent changes to the same. BE IT FURTHER RESOLVED, That the Plan Commission approve paving to be done by July 1, 1996, and the landscaping completed by September 1, 1996, that there be no outside storage of junk vehicles or vehicle parts, that future lighting Resolution #P.C. 47-96 Page 2 be of sodium vapor in nature and approved by Planning Department staff, and the vehicle repair done be prep work only. BE IT FURTHER RESOLVED, That no more than 24 vehicles for sale or being prepped are permitted on site at one time. BE IT FURTHER RESOLVED, That all aspects of this building, site and operation plan as they relate to the building, parking and drive areas, landscaped areas and signage shall be maintained in perpetuity unless otherwise authorized by the Plan Commission. BE IT FURTHER RESOLVED, That failure to comply with the conditions of this approval shall result in the imposition of fines of $100 per day per violation, the initiation of legal action, or both.
