PCR1995193AMENDED RESOLUTION #P.C. 193-95 APPROVAL OF AMENDMENT TO OPD OF APPLETREE ESTATES TO ALLOW 2.59 ACRES TO BE SOLD TO WASTE MANAGEMENT existing OPD of Appletree Estates to allow 2.59 acres of the property to be sold to Waste Management, and WHEREAS, Mr. & Mrs. Bucky Lowe are requesting to amend the illustrating 11 single family lots was approved by the Plan Commission on October 6, 1992, and WHEREAS, A conceptual plan for Apple Tree Estates approved by the Common Council on February 24, 1993 and said WHEREAS, A Preliminary Plat for Apple Tree Estates was preliminary plat substantially conforms to the conceptual plan, and deeds office defining the total boundaries of Apple Tree Estates WHEREAS, OPD documents were recorded at the register of as defined by the conceptual plan and Preliminary Plat which included the subject lands, and WHEREAS, The petitioner withdrew their subdivision final plat to create the proposed Apple Tree Estates on April 18, 1994, and however the OPD documents still exist as recorded, and THEREFORE BE IT RESOLVED, That the Plan Commission approves of the amendment to the OPD of Appletree Estates subdivision creating a one parcel of 2.59 acres of the property located in the NE 1/4 of Section 18. BE IT FURTHER RESOLVED, That the additional proposal to amend the OPD to allow 16 lots is, at this time, rejected. BE IT FURTHER RESOLVED, That the Plan Commission considers this amendment, exclusive of the 16 lot proposal, to be non-substantial. parcel will allow only 8 additional lots under the current OPD Certified Survey Map) and that a warranty deed is required for (as two lots have already been divided by a previously approved the 2.59 acre parcel indicating that the property is encumbered by the previously recorded Declaration of Restrictions of the Apple Tree Estates.
