PCR1995167RESOLUTION #P.C. 167-95 APPROVAL OF 12' X 12' SECOND GARAGE FOR THE PROPERTY LOCATED AT W147 S6960 DURHAM DRIVE on October 5, 1995, to construct a 12' X 12' second garage structure at the residence located at W147 S6960 Durham Drive, and WHEREAS, A site plan and construction information was submitted WHEREAS, The location of the second garage will meet the setbacks of the RS-3 zoning district and the architectural appearance would be compatible with the applicant's residence and surrounding area, and WHEREAS, The second garage is intended to be used for storage and the Plan Commission has authority to approve the type and size of second garage structures, and this nor any other structure on the property for business related activities, and WHEREAS, Materials submitted do not propose the use neither of WHEREAS, At 144 square feet, the proposed second garage structure represents 19% of the total permitted square footage of outbuildings which is 747 square feet. the second garage, not to exceed 144 square feet and 15 feet in height, for the Foye Property. THEREFORE BE IT RESOLVED, That the Plan Commission approves Of BE IT FURTHER RESOLVED, That subject second garage shall business related materials and equipment and a building permit is neither be used for the operation of a business nor the storage of required prior to construction of subject second garage. BE IT FURTHER RESOLVED, That a fire wall or height variance may be required from the Board of Appeals. BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution and the approved site plans shall result in the issuance of fines of $100 per day per violation, the initiation of legal action, or both.
