APPROVAL OF LEGAL LOT STATUS OF LOT'S 9 & 10,
11 & 12, AND 13 h 14 IN THE HOLZ SUBDIVISION
TAX KEY #'S 2211.030, 2211.031, 2211.032,
2211.033, 2211.034, and 2211.035
WHEREAS, A request has been submitted by Thomas Buechel,
owner of land on Holz Drive, Tax Key #2211.030, 2211.031,
2211.032, 2211.033, 2211.034, and 2211.035 for a determination
of legal lot status for a portion the above mentioned parcel,
and
District, which requires a minimum 175' of average width and a
60,000 sq. ft. lot size, and
WHEREAS, The property is currently zoned R-2 Zoning
WHEREAS, With the proposed HiView-Holz Lane Sewer Project
this property will be rezoned to RSE Zoning District, which
requires a minimum 150' of average width and a 40,000 sq.ft. lot
size, and
WHEREAS, The lots have a combined average width of over 110
feet and square footage of 18,052, 21,972 and 23,517 square feet
which does not meet the requirements of the RSE Zoning District,
however lots adjoining the subject property and in the immediate
area are the same general size and several Legal Lot Status
applications have been approved in this vicinity.
WHEREAS, The re-division of existing neighboring
non-conforming lots in common ownership requires Legal Lot
by certified survey map review and approval by the same bodies,
Status review by the Plan Commission and Common Council followed
and
existing substandard lots under common ownership and bring them
into conformance and/or compatibility with existing neighboring
lots, and
WHEREAS, The Plan Commission has the authority to approve
the availability of sewer service from Holz Drive.
WHEREAS The properties have direct access to Holz Drive with
approval for legal lot status for the property described as Lot
9 h 10, 11 & 12, and 13 & 14, Holz Subdivision, Tax Key #'s
2211.030, 2211.031, 2211.032, 2211.033, 2211.034 & 2211.035 for
Thomas Buechel .
THEREFORE, BE IT RESOLVED, That the Plan Commission recommend
BE IT FURTHER RESOLVED, That this approval is subject to the
installation of the sanitary sewers and submittal for approval
of a certified survey map.
