PCR1995146APPROVAL OF 36' x 45' SECOND GARAGE RESOLUTION #P.C. 146-95 AT W193 S6885 HILLENDALE DRIVE FOR THE PROPERTY LOCATED WHEREAS, A site plan and construction information was submitted on August 28, 1995, to construct a 36' X 45' second garage structure at the residence located at W193 56885 Hillendale Drive, and structure for this location through Resolution P.C.108-95 subject to a size variance being granted by the Board of Appeals, and WHEREAS, The Board of Appeals approved a 36' X 36' second WHEREAS, The Plan Commission approved a 36' X 36' second garage garage structure for this location through Appeal # 26-95, and setbacks of the RS-2 zoning district and the architectural WHEREAS, The location of the second garage will meet the appearance would be compatible with the applicant's residence and surrounding area, and WHEREAS, The second garage is intended to be used for storage and the Plan Commission has authority to approve the type and size of second garage structures, and this nor any other structure on the property for business related activities, and WHEREAS, Materials submitted do not propose the use neither of WHEREAS, The proposed second garage structure, when combined with an existing 24.3 ft X 25.3 ft garage to remain, represent 134% of the ground floor area of the home or 2,235 square feet. THEREFORE BE IT RESOLVED, That the Plan Commission approves of the second garage, not to exceed 382 square feet, for the Haupt Property. BE IT FURTHER RESOLVED, That subject second garage shall neither be used for the operation of a business nor the storage of business related materials and equipment and a building permit is required prior to construction of subject second garage. BE IT FURTHER RESOLVED, That the existing 20.3' X 20.3' second garage structure will be razed. BE IT FURTHER RESOLVED, That a wood or metal framed garage in excess of 720 square feet without a dividing fire wall will require a variance from the Board of Appeals. BE IT FURTHER RESOLVED, That a height variance will be required from the Board of Appeals if subject garage exceeds a height of fifteen (15) feet. of this resolution and the approved site plans shall result in the issuance of fines of $100 per day per violation, the initiation of legal action, or both.
