RECOMMENDATION OF APPROVAL TO AMEND CHAPTER 17:3.04(4)C

LAKESHORE DISTRICT
(CITY OF MUSKEGO)
WHEREAS, As currently described, Chapter 17:3.04(4)C
establishes the boundary of the OLS Lakeshore District around
the shore of all public water bodies which legal counsel has
interpreted to not only apply to lakeshore properties but also
all navigable public water bodies including streams, creeks,
canals, and
WHEREAS, As currently defined, Chapter 17:9.04 defines the
OLS Lakeshore District as intending to apply exclusively to
lakeshore properties, and
establishes the boundary of the WF Wetland and Floodplain
District as those areas at the edges of lakes, streams, swamps,
marshes or other lands not adequately drained, and
WHEREAS, As currently described, Chapter 17:3.04(4)8
application of the OLS and WF districts district.
WHEREAS, There exists an conflict in the purpose and
NOW THEREFORE BE IT RESOLVED, That the Plan Commission
recommend approval to the Common Council the proposed amendments
to Chapter 17:3.04(4)C which removes the phrase "public water
bodies" and adds in its place the phrase "public lakes", and
adds the following wording: "The Lakeshore District shall
extend upstream along any navigable tributary to a public lakes
and bays to the first portage point/obstruction."
