PCR1995109RESOLUTION #P.C.109-95 APPROVAL OF A 24' X 24' SECOND GARAGE FOR THE SCHMIDT PROPERTY LOCATED AT S105 W15746 LOOMIS DRIVE submitted on June 28, 1995, by Todd Schmidt to construct a 24' X 24' second garage structure at the residence located at S105 W15746 Loomis Drive, and WHEREAS, A site plan and construction information was northwest corner of the property will be razed, and WHEREAS, The existing garage totaling 695.7 square feet on the the setbacks of the Agriculture zoning district and the WHEREAS, The location of the proposed second garage will meet architectural appearance would be compatible with the applicant's residence and surrounding area, and WHEREAS, The second garage is intended to be used for storage and the Plan Commission has authority to approve the type and size of second garage structures, and WHEREAS, Materials submitted do not propose the use neither of this nor any other structure on the property for business related activities, and the area of the parcel. WHEREAS, The existing and proposed garage represents 0.61% of THEREFORE BE IT RESOLVED, That the Plan Commission approves Of the second garage, not to exceed 576 square feet and a total square footage of combined outbuildings not to exceed 1,336.46 square feet, for Schmidt Property. BE IT FURTHER RESOLVED, That subject garage shall neither be used for the operation of a business nor the storage of business related materials and equipment and a building permit is required prior to construction of subject garage. BE IT FURTHER RESOLVED, That a fire wall variance may be required from the Board of Appeals. BE IT FURTHER RESOLVED, That a height variance Will be required from the Board of Appeals if subject garage exceeds a height of fifteen (15) feet. BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution and the approved site plans shall result in the issuance of fines of $100 per day per violation, the initiation of legal action, or both.
