PCR1995103DISAPPROVAL OF PRELIMINARY PLAT FOR CANDLEWOOD CREEK SUBDIVISION FOR THE PROPERTY LOCATED IN THE SE 1/4 OF RESOLUTION #P.C.103-95 SECTION 3, NE 1/4 OF SECTION 10, AND NE & NW 1/4 OF SECTION 11 WHEREAS, A Preliminary Plat was submitted on June 2, 1995, to divide property in the SE 1/4 of Section 3, NE 1/4 of Section fifty-seven (257) single family lots and three (3) outlots, and 10, and the NE & NW 1/4 of Section 11 into two hundred WHEREAS, Subject Preliminary Plat, in conflict with the requirements of the Muskego Land Division Ordinance Section 18.21(1) Dedication and Preservation of Lands, Streets, Muskego Comprehensive Land Use Plan as adopted September 15, Highways, and Drainageways, fails to conform to the City of Moorland Road, and 1992 per Resolution #P.C. 161-92 in relation to the future requirements of the Muskego Land Division Ordinance Section WHEREAS, Subject Preliminary Plat, in conflict with the 18.21(1) Dedication and Preservation of Lands, Streets, Highways, and Drainageways, fails to conform to the City of Muskego Year 2010 Arterial Street and Highway System Plan as adopted in October of 1993 in relation to the future Moorland Road, and WHEREAS, Subject Preliminary Plat, in conflict with the requirements of Muskego Land Division Ordinance Section 18.30(2) Preapplication preliminary sketch approval, fails to conform to the Revised Sketch for the Preliminary Plat for Candlewood Creek per Resolution #P.C. 16-93 , and Subdivision as adopted by the Plan Commission on March 2, 1993 WHEREAS, Subject Preliminary Plat, in conflict with the requirements of Muskego Land Division Ordinance Section 18.31 Preliminary Plat, fails to conform to the previously approved Preliminary Plat for Candlewood Creek Subdivision approved by the Common Council on June 22, 1993 per Resolution #158-93 WHEREAS, Per The Muskego Land Division Ordinance Section technical discrepancies and design concerns exist such as 18.31(3) Preliminary Plat, Submittal Requirements, numerous incomplete information presented on the Preliminary Plat, connectivity to neighboring lands and/or subdivisions. improper street alignments and intersection spacing, lack of THEREFORE BE IT RESOLVED, That the Plan Commission disapprove the Revised Preliminary Plat for Candlewood Creek Subdivision in the SE 1/4 of Section 3, NE 1/4 of Section 10, and the NE & NW 1/4 of Section 11 and finds the following: 1. The Subject Preliminary Plat fails to conform to the adopted City of Muskego Comprehensive Land Use Plan. 2. The Subject Preliminary Plat fails to conform to the Highway System Plan. adopted City of Muskego Year 2010 Arterial Street and 3. The Subject Preliminary Plat fails to conform to the previously approved Revised Sketch for the Preliminary Plat of Candlewood Creek Subdivision. 4. The Subject Preliminary Plat fails to conform to the previously approved Preliminary Plat of Candlewood Creek Subdivision. 5. The Subject Preliminary Plat fails to conform to the requirements of the Muskego Land Division Ordinance submittal requirements for preliminary plats.
