PCR1995092a APPROVAL OF A 36' x 54' SECOND GARAGE RESOLUTION #P.C. 92-95 FOR THE HAUPT PROPERTY LOCATED AT W193 S6885 HILLENDALE DRIVE on June 8, 1995, by Steven Haupt to construct a 36' X 54' second garage structure at the residence located at W193 S6885 Hillendale Drive, and WHEREAS, A site plan and construction information was submitted setbacks of the R-2 zoning district and the architectural WHEREAS, The location of the second garage will meet the appearance would be compatible with the applicant's residence and surrounding area, and and the Plan Commission has authority to approve the type and size of second garage structures, and WHEREAS, The second garage is intended to be used for storage WHEREAS, Materials submitted do not propose the use neither of this nor any other structure on the property for business related activities, and existing 24.3 ft X 25.3 ft garage to remain, represents 153% of the WHEREAS, The proposed pole building, when combined with an ground floor area of the home or 2,558.79 square feet.. THEREFORE BE IT RESOLVED, That the Plan Commission approves of the pole building, not to exceed 381.61 square feet, for Haupt Property, that the pole building have eaves measuring no less than one foot, and that the pole building not exceed 15 feet in height. BE IT FURTHER RESOLVED, That the petitioner is required to petition the Board of Appeals for a square footage variance if he chooses to further pursue an approval for a pole building larger than 383.61 square feet. BE IT FURTHER RESOLVED, That a fire wall variance may be required from the Board of Appeals. BE IT FURTHER RESOLVED, That subject second garage shall neither be used for the operation of a business nor the storage of business related materials and equipment and a building permit is required prior to construction of subject second garage. BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution and the approved site plans shall result in the issuance of fines of $100 per day per violation, the initiation of legal action, or both.
