PCR1995087AMENDED APPROVAL OF CONDITIONAL USE GRANT AND BUILDING, SITE & RESOLUTION P.C. 87-95 OPERATION PLAN TO ALLOW AN OUTDOOR RECREATION FACILITY (FOR PRIVATE/NONCOMMERCIAL PERSONAL USE) ACCOMPANIED BY 60' X 136' POLE BUILDING LOCATED AT W144 S7880 DURHAM DRIVE outdoor recreation facility (for private/noncommercial personal use) accompanied by 60' x 136' Pole Building Located at W144 S7880 Durham Drive, and WHEREAS, A request was received on May 17, 1995, to allow an WHEREAS, The subject property is zoned RS-2 Suburban Residence and RS-2/0HS Suburban Residence/Overlay Highway Service, and property have been notified of the public hearing, and said WHEREAS, The owners of property within 300 feet of this public hearing has been held in conformance with Section 17:3.07 of the City's Code of Ordinances, and WHEREAS, Access to the property is from Durham Drive, and WHEREAS, A detailed site plan has been submitted for approval, and WHEREAS, Existing outbuildings total 1,364 square feet, the proposed outbuilding totals 8,160 square feet thus the grand total square footage of outbuildings is proposed to be 9,524 square feet, and WHEREAS, The parent parcel totals 236,966 square feet and this request, along with existing outbuildings, represents 4% of the lot area. THEREFORE BE IT RESOLVED, That the Plan Commission approve by Dave Machi and that the Building, Site and Operation Plan the Conditional Use Grant and Building, Site, and Operation plan dated received May 17, 1995, be kept on file in the Building Department. BE IT FURTHER RESOLVED, That the height of the building shall not exceed 25 feet to the ridge, the side and rear yard offsets shall not be less than 50 feet, and that a fire wall variance my be required from the Board of Appeals. BE IT FURTHER RESOLVED, That all aspects of this Building, Site and operation plan as they relate to the building, parking perpetuity unless otherwise authorized by the Plan Commission. and drive areas, landscaped areas shall be maintained in BE IT FURTHER RESOLVED, That failure to comply with the conditions of this Building, Site and Operation Plan shall result in the imposition of fines of $100 per day per violation, the initiation of legal action, or both. BE IT FURTHER RESOLVED, That the 60' x 136' building will be used for inside personal recreational riding facility with 0 the availability of storage of all personal property and an outdoor corral.
