PCR1995077AMENDED RESOLUTION P.C. 71-95 APPROVAL OF AMENDED CONDITIONAL USE GRANT AND BUILDING, SITE & OPERATION PLAN TO ALLOW A CAR WASH FACILITY LOCATED AT 576 W17871 JANESVILLE ROAD WHEREAS, A amended Conditional Use Grant and Building, Site and Operation plan was received on May 5, 1995, and Business and the proposed use requires a conditional use grant, and WHEREAS, The subject property is zoned B-3 - General property have been notified of the public hearing, and said WHEREAS, The owners of property within 300 feet of this public hearing has been held in conformance with Section 17:3.07 of the City's Code of Ordinances, and WHEREAS, Access to the property is from CTH "L" , and WHEREAS, It is proposed to operate a car wash facility in addition to the existing business, and THEREFORE BE IT RESOLVED, That the Plan Commission approve the amended Building, Site, and Operation plan for Johnny's Petroleum and that the Building, Site and Operation Plan dated received June 6, 1995, be kept on file in the Building Department. BE IT FURTHER RESOLVED, That a bond, letter of credit shall be submitted to the City, in the City's favor, equal to twice the value of paving and landscaping improvements. Said bond shall be released upon completion of improvements or forfeited if occupancy requested prior to the installation of landscaping. BE IT FURTHER RESOLVED, That failure to perpetually comply with the conditions of this Building, Site and Operation Plan shall result in the imposition of fines of $100 per day per violation, the initiation of legal action, or both. submitted for approval.
