PCR1995074APPROVAL OF A 60' x 136' POLE BUILDING BY RESOLUTION #P.C. 74-95 DAVE MACH1 FOR THE PROPERTY LOCATED AT W144 57880 DURHAM DRIVE WHEREAS, A site plan and construction information was submitted on May 5, 1995, by Dave Machi to construct a 60' X 136' Pole Barn at the residence located at W144 S7880 Durham Drive, and setbacks of the RS-Z/OHS zoning district and the architectural appearance would be compatible with the applicant's residence and surrounding area, and WHEREAS, The location of the second garage will meet the WHEREAS, The pole barn is intended to be used for storage of tractor, horse supplies, and an area to exercise petitioner's own personal horses (no commercial activities) and the Plan Commission has authority to approve the type and size of outbuildings within one (1) percent of the total square footage of the lot, and WHEREAS, the parcel contains over 120,000 square feet, allowing for the square footage of total outbuildings equal to one (1) percent of the total square footage of the lot, (1) percent equaling 2,369.7 square feet, and WHEREAS, said lot is equal to 236,966.4 square feet with one sq.ft. pole barn in addition to other existing outbuildings totaling 1,364 square feet, the total of the two equaling approximately four (4) percent of the total square footage of the lot. WHEREAS, The petitioner is proposing to construct a 8,160 WHEREAS, The Plan Commission has the authority to approved outbuildings in excess of the one (1) percent rule if, in the Plan Commissions opinion, the surrounding area is considered to be "predominantly undeveloped" (per Section 17:8.01(7)B. Permitted Accessory Uses). THEREFORE BE IT RESOLVED, That the Plan Commission finds the approves of the construction of a the pole barn not to exceed 8,160 surrounding area to be predominantly undeveloped and therefore square feet, and that neither shall the total of all outbuildings on the parent property exceed 9,600 square feet nor the total acreage of the parent property ever be less than 236,996.4 square feet . BE IT FURTHER RESOLVED, That subject pole barn shall neither be used for the operation of a business nor the storage of business related materials and equipment and a building permit is required prior to construction of subject second garage. BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution and the approved site plans shall result in the issuance of fines of $100 per day per violation, the initiation of legal action, or both.
