AMENDED
APPROVAL OF BUILDING, SITE AND OPERATION PLAN BY
CULVER'S CUSTARD STAND/RESTAURANT LOCATED ON RACINE AVENUE
(NORTH OF INDUSTRIAL PARK - WEST SIDE OF ROAD)
WHEREAS, The site plan shows the layout of the building and
the traffic pattern to access the site, and
WHEREAS, The City of Muskego requires that all developments
provide an adequately screened area for a dumpster and recycling
bin for each building and this development will have those
facilities, and
WHEREAS, The property is zoned RS-Z/OOS Residential/Office
and Special Service Overlay and such zoning allows for the
restaurants not serving alcohol, and
brick and blue raised asphalt or fiberglass shingle roof, and
is proposed to have a patio area within the setback area
containing thereon patio furniture, and
WHEREAS, The proposed building consists of cream colored
and Janesville Road indicate that cross access agreements
between this and neighboring properties are warranted.
WHEREAS, Traffic levels at the intersection of Racine Ave.
THEREFORE BE IT RESOLVED, That the Plan Commission approve
the Building, Site, and Operation plan dated (received) April
21, 1995, and be kept on file in the Building Department.
BE IT FURTHER RESOLVED, That failure to comply with the
conditions of this approval shall result in the imposition of
fines of $100 per day per violation, the initiation of legal
action, or both.
BE IT FURTHER RESOLVED, That a landscape bond, letter of
credit or cashier's check equal to twice the value of the
proposed landscaping shall be filed with the Planning Department
installation.

BE IT FURTHER RESOLVED, That this approval is subject to the
following conditions:
1. Patio furniture in the setback area is approved
subject to it not being secured to the patio or of a
permanent nature.
2. Letter of understanding regarding cross access easement
3. Receipt of letter of agreement of regarding
4. Additional planting of 6-8 trees in landscaped areas.
5. Submit for staff approval revised signage.

BE IT FURTHER RESOLVED, That the entire site including the
building and all landscaping is to be maintained in perpetuity.
