APPROVAL OF CONDITIONAL USE GRANT AND BUILDING, SITE h
LOCATED AT S74 W16810 JANESVILLE ROAD,
OPERATION PLAN TO ALLOW A OLSON'S LAWN TRACTOR
WHEREAS, A conceptual Building, Site and Operation plan was
approved through the adoption of Resolution #P.C. 215-94 on
November 15, 1994, and
Business/Overlay Planned Development, and
WHEREAS, The subject property is zoned B-4/0PD - General
Conditional Use Grant application were submitted to the Planning
WHEREAS, Formal building, site and operation plans and a
Department by Olson's Lawn Tractor for the property located at
574 W16810 Janesville Road, and
property have been notified of the public hearing, and said
WHEREAS, The owners of property within 300 feet of this
public hearing has been held in conformance with Section 17:3.07
of the City's Code of Ordinances, and
WHEREAS, The petitioner is proposing to conduct their lawn
tractor service and sales business from a new building and
perpetuate single family residential quarters in an existing
dwelling on the same property, and
WHEREAS, Access to the property is from Janesville Road (CTH
"L") and the property is served by sanitary sewer and municipal
water, and
WHEREAS, A detailed site plan and building elevations have
been submitted for approval.
THEREFORE BE IT RESOLVED, That the Plan Commission approve
the Conditional Use Grant and Building, Site, and Operation plan
by Olson's Lawn Tractor and that the Building, Site and
Operation Plan dated received March 28, 1995, be kept on file in
the Building Department.
Site and operation plan as they relate to the building, parking
and drive areas, landscaped areas shall be maintained in
perpetuity unless otherwise authorized by the Plan Commission.
BE IT FURTHER RESOLVED, That all aspects of this Building,
BE IT FURTHER RESOLVED, That the conditions of this approval
are as follows:
1. All anticipated signage shall be submitted to the Plan
Commission for their review and approval prior to
installation.
2. A grading and drainage plan shall be approved by the
Public Works Commission prior to issuance of any
occupancy permit for this project.
3. A bond, cashier's check or letter of credit equal to
twice the value of the proposed landscaping shall be
filled with the Planning Department if occupancy of
the new building is requested prior to the
installation of landscaping.
4. Prior to occupancy of the new building petitioner
shall install a turn lane into the property unless
deemed unnecessary by Waukesha County Department of
Transportation.
5. No outside storage, repair or display for sale of
equipment, materials or products awaiting repair,
pick-up or sale.
6. No outside storage of junked equipment or "parts"
equipment, materials or products.
BE IT FURTHER RESOLVED, That failure to comply with the
conditions of this Building, Site and Operation Plan shall
result in the imposition of fines of $100 per day per violation,
the initiation of legal action, or both.
BE IT FURTHER RESOLVED, That the 4' evergreens will be
planted in a staggered formation on a six (6) foot center along
the north property line.
BE IT FURTHER RESOLVED, That the lighting along the west
elevation will be four (4) sodium vapor wall packs and the
southern elevation will be recessed lighting in the brow of the
overhang of the building directed towards the building.
BE IT FURTHER RESOLVED, That two additional parking stalls
(10' x 40' for each stall) to allow for parking of vehicles
with trailers along the northwestern area of the parking lot
are required for this site.
