PCR1995050RESOLUTION #P.C. 50-95 AMENDED APPROVAL OF A 435.25 SQUARE FOOT SECOND GARAGE BY JEFF JAHNKE FOR THE PROPERTY LOCATED AT S69 W18004 MUSKEG0 DRIVE WHEREAS, A site plan and construction information was submitted on March 24, 1995, by Jeff Jahnke to construct a 24' X 28' second Drive, and garage structure at the residence located at 569 W18004 Muskego WHEREAS, The proposed location of the second garage will not meet the setbacks of the RS-3/0ED zoning district but the architectural appearance would be compatible with the applicant's residence and surrounding area, and of car, boat, lawn tools, snow blower and motorcycle and the Plan WHEREAS, The second garage is intended to be used for storage Commission has authority to approve the type and size of second garage structures within 60% of the ground floor area of the residence which in this case totals 759.99 square feet, and second garage which in itself exceeds the allowed square footage by WHEREAS, The petitioner is proposing to construct a 672 sq.ft. 90 square feet, but when combined with an existing 147 square foot shed exceeds allowed square footage by 68 square feet. this nor any other structure on the property for business related activities, and WHEREAS, Materials submitted do not propose the use neither of THEREFORE BE IT RESOLVED, That the Plan Commission approves Of the second garage, not to exceed 604 square feet, for Jahnke Property. BE IT FURTHER RESOLVED, That subject second garage shall neither be used for the operation of a business nor the storage of business related materials and equipment and a building permit is required prior to construction of subject second garage. BE IT FURTHER RESOLVED, That a fire wall and/or building setback and/or building square footage variance may be required from the Board of Appeals if setback, offset, building separation and square footage limitations can not be complied with. BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution and the approved site plans shall result in the issuance of fines of $100 per day per violation, the initiation of legal action, or both.
