PCR1995048RESOLUTION #P.C. 48-95 APPROVAL OF A 14' x 22' SECOND GARAGE BY ROBERT & KATHLEEN POSS FOR THE PROPERTY LOCATED AT 582 W12877 ACKER DRIVE on March 23, 1995, by Robert Poss to construct a 14' X 22' second garage structure at the residence located at S82 W12877 Acker Drive, and WHEREAS, A site plan and construction information was submitted WHEREAS, The location of the second garage will meet the appearance would be compatible with the applicant's residence and setbacks of the R-2 zoning district and the architectural surrounding area, and WHEREAS, The second garage is intended to be used for storage of yard equipment, boat, children's toys, etc. and the Plan Commission has authority to approve the type and size of second garage structures within 60% of the ground floor area of the residence, and WHEREAS, Materials submitted do not propose the use neither of this nor any other structure on the property for business related activities, and WHEREAS, The petitioner is proposing to construct a 308 sq.ft. of the home. second garage equaling approximately 22% of the ground floor area THEREFORE BE IT RESOLVED, That the Plan Commission approves of the second garage, not to exceed 308 square feet, for Poss Property. BE IT FURTHER RESOLVED, That subject second garage shall neither be used for the operation of a business nor the storage of business related materials and equipment and a building permit is required prior to construction of subject second garage. BE IT FURTHER RESOLVED, That a fire wall variance may be required from the Board of Appeals. of this resolution and the approved site plans shall result in the issuance of fines of $100 per day per violation, the initiation of legal action, or both.
