PCR19942320 APPROVAL OF REQUEST TO ALLOW DRIVEWAY ENCROACHMENT RESOLUTION #P.C. 232-94 OF APPROXIMATELY 16' FOR THE DRIVEWAY ACCESS FOR THE PROPERTY LOCATED W199 S8588 BENDINGBRAE DRIVE WHEREAS, A request was submitted on December 9, 1994, requesting that the existing cement driveway encroachment and located at W199 58588 Bendingbrae Drive be allowed to remain, WHEREAS, Through the approval of the Final Plat of Plum Creek Subdivision there was a restriction placed on the face of the Plat restricting the driveway access of this property to the most easterly 40' of said property, and WHEREAS, The existing cement driveway encroaches approximately 16' west of the said driveway restriction, and WHEREAS, The driveway setback from the intersection of Bendingbrae and Woods Road will be greater than 50 feet, and WHEREAS, A driveway setback of 50 feet is a recognized standard which the City has used in other subdivisions. THEREFORE BE IT RESOLVED, That the Plan Commission approve the request to allow driveway encroachment of approximately 16' for the property located at W199 S8588 Bendingbrae Drive.
