APPROVAL OF CONCEPTUAL REQUEST TO USE THE PROPERTY
AND BUILDINGS LOCATED AT W124 511093 S. 124TH STREET
AS AN ANTIQUE SHOP (REALTY CENTER)
WHEREAS, A Conceptual Conditional Use Grant request was
submitted on November 4, 1994, by The Realty Center, Inc. for
the property located at W124 511093 S. 124th Street, and
currently accommodates a tavern considered to be a
nonconfroming use, and
WHEREAS, The subject property is zoned A - Agriculture and
WHEREAS, The Plan Commission has the authority under Section
of nonconforming buildings and/or properties if that new use is
4.06(2)B. & C. of the Zoning Ordinance to approved the new use
determined to result in no greater degree of nonconformity, and
WHEREAS, A detailed site plan, building elevations and sign
proposal are required to be submitted and approved prior to the
construction of any facilities or the use of the subject
buildings and/or property, and
WHEREAS, Access to the property would be from 124th Street
and Union Church Road, and
THEREFORE BE IT RESOLVED, That the Plan Commission approves
in concept the use of the buildings and property at W124 S11093
of the proposal as presented in items submitted by the
South 124th Street as an antique shop subject to the description
petitioner and dated November 4, 1994, and the hard surfacing
of the parking area, no outside storage, an antique store & two
(2) rental units and the garage must be used for residential
use only.
BE IT FURTHER RESOLVED, That a detailed Building, Site and
Operation Plan must be submitted for approval by the Plan
Commission prior to the use of subject buildings and/or property
for an antique shop.
BE IT FURTHER RESOLVED, That the Conceptual Building, Site
and Operation Plan dated received November 4, 1994, be kept on
file in the Building Department.
