PCR1994195AMENDED RESOLUTION #P.C. 195-94 OF THE EICHE PROPERTY BY PREMIERE DEVELOPMENT LOCATED IN THE SW 1/4 OF SECTION 10 APPROVAL OF A REVISED SKETCH FOR PRELIMINARY PLAT WHEREAS, A Sketch was submitted on June 12, 1992, to divide property in the the SW 1/4 of Section 10 into 81 single family lots under RS-2 Zoning was adopted through Resolution #P.C. 152-92, on July 7, 1992 with the following conditions: 1. All lots will meet the requirements of the RS-2 2. Deed restrictions will be placed on all lots Zoning District size and width requirements; adjacent to Parkland Drive to restrict access to Drive (lots 1, 58, 59 and 71); Parkland Drive as well as corner lots on Lannon from south of Lake Ridge Apartments to the WEPCO right-of-way to provide access to the bike path; preliminary plat. 3. There be a dedicated right-of-way along Lannon Road 4. The limits of the two (2) ponds be depicted on the 1994, to divide property in the SW 1/4 of Section 10 into nine (9) duplex lots and fifty-six (56) single family lots, and WHEREAS, The property is currently zoned RS-2 Suburban Residence which requires a minimum lot size of 20,000 sq. ft. and a minimum average width of 110' and the proposed use would require a rezoning to OPD, and WHEREAS, A revised sketch was submitted on September 23, WHEREAS, The application of an OPD designation to this property will allow minimum lot sizes of 18,000 sq. ft. THEREFORE BE IT RESOLVED, That the Plan Commission approve of the revised sketch and are receptive to the submittal of a Preliminary Plat creating a land division in the SW 1/4 of Section 10 for the Eiche property. BE IT FURTHER RESOLVED, That the proposed through street to Lannon Drive be changed to a cul de sac and the monies saved required to be escrowed by the Developer to apply towards the from not installing the deceleration/acceleration lanes are Drive and CTH "L" and held by the City and if not installed, possible installation of a signalized intersection at Parkland then monies are to be refunded to the Developer. the removal of all proposed multi family in this proposed subdivision.
