PCR1994193DISAPPROVAL OF THE CONCEPTUAL REZONING FROM RESOLUTION #P.C. 193-94 COLLEGE AVENUE & TESS CORNERS DRIVE RS-l/OOS TO RS-l/OD AT THE PROPERTY LOCATED AT SW CORNER OF NE 1/4 SECTION 2 WHEREAS, Mr. Richard Burback is requesting the concept rezoning of the property located at SW corner of College Avenue & Tess Corners Drive to allow a two family (duplex) property, and WHEREAS, This property is bordered on the south, west and north by the single family properties and on the east by 1-1 Industrial properties, and WHEREAS, The Land Use 2005 Map found in the Comprehensive Plan indicates medium density, and RS-l/OOS Single Family/Overlay Office & Special Service Zoning WHEREAS, A review of zoning regulations imposed by the which exists on subject parcel points out the requirement of 30,000 square feet in minimum lot size and 120 feet in minimum lot width, and WHEREAS, A review of the OD Duplex Overlay zoning regulations stipulates a minimum of 60,000 square feet in lot size and 240 feet in minimum lot width, and 285 feet in lot width. WHEREAS, Subject lot totals 38,106 square feet in size and THEREFORE BE IT RESOLVED, That the Plan Commission disprove the conceptual rezoning from RS-l/OOS to RS-l/OD for the property located on the SW corner of College Avenue and Tess Corners Drive as the subject lot is substandard in square footage when considering the proposed addition of OD zoning to the RS-1 zoning.
