on July 21, 1994 by Mary Ziegler to construct a 20' X 22' second
WHEREAS, A site plan and construction information was submitted
garage structure at the residence located at W200 S10721 East Shore
Drive, and
WHEREAS, The location of the second garage will meet the
appearance would be compatible with the applicant's residence and
setbacks of the RS-2/0LS zoning district and the architectural
surrounding area, and
of two (2) vehicles and the Plan Commission has authority to
approve the type and size of second garage structures within 60% of
the ground floor area of the residence, and
WHEREAS, The second garage is intended to be used for storage
this nor any other structure on the property for business related
activities, and
WHEREAS, Materials submitted do not propose the use neither of
WHEREAS, The petitioner is proposing to construct a 440 sq.ft.
square foot second garage which exceeds the allowed size by 258.89
sq.ft. and a variance would be required from the Board of Appeals.
WHEREAS, To comply with the Ordinance the petitioner could
construct a 181.11 sq.ft. second garage structure.
THEREFORE BE IT RESOLVED, That the Plan Commission approves Of
the second garage, not to exceed 440 square feet, for Mary
Ziegler subject to the Board of Appeals granting a variance for
the size of the building. If a variance is not granted the
building must meet the setbacks as required and a revised site
plan submitted to the Plan Commission for review and approval.
BE IT FURTHER RESOLVED, That subject second garage shall
neither be used for the operation of a business nor the storage of
business related materials and equipment and a building permit is
required prior to construction of subject second garage.
BE IT FURTHER RESOLVED, That a fire wall variance may be
required from the Board of Appeals.
BE IT FURTHER RESOLVED, That failure to comply with the terms
of this resolution and the approved site plans shall result in the
issuance of fines of $100 per day per violation, the initiation of
legal action, or both.
