RECOMMENDATION OF APPROVAL OF REZONING FROM RS-2 TO
RS-2/0D AT THE PROPERTY LOCATED IN THE NE 1/4 SECTION 1
(SE CORNER OF KIPLING DRIVE AND JANESVILLE ROAD)

RESOLUTION #P.C. 140-94
WHEREAS, A petition has been submitted to rezone the
property in the NE 1/4 of Section 1 from RS-2 to RS-Z/OD for the
purpose of development of a two family (duplex) property located
at said property, and
WHEREAS, This property is bordered on the south by the
single family zoned property, bordered on the north by farm land
with an Office and Special Service overlay, on the east by
(City of New Berlin), on the west by single family residential
single family, and then a 4 family building which is located in
New Berlin, and
WHEREAS, The Land Use 2005 Map found in the Comprehensive
Plan indicates medium density, and
WHEREAS, A review of zoning regulations imposed by the RS-2
Single Family zoning which exists on subject parcel points out
the reauirement of 20,000 sauare feet in minimum lot area and
110 feet in minimum lot width, and
WHEREAS, A review of the OD Duplex Overlay zoning
regulations stipulates a minimum of 40,000 square feet in lot
area and 220 feet in minimum lot width, and
WHEREAS, Subject lot totals approximately 44,900 square feet
in size and 240 feet in lot width thus exceeding area and width
requirements of the existing and proposed zoning, and medium
density requirements of the 2005 Land Use Plan.
WHEREAS, On June 7, 1994 through Resolution #P.C. 108-94 the
Plan Commission approved in concept the goals of this request,
and
WHEREAS, A Public Hearing is scheduled to be held before the
Common Council on Tuesday, July 26, 1994, at 7:25 p.m. to
consider the formal rezoning petition.
THEREFORE BE IT RESOLVED, That the Plan Commission
recommends approval to the Common Council of the request to
rezone from RS-2 to RS-2/0D the property located in the NE 1/4
of Section 1 (SE corner of Janesville Road and Kipling Drive),
Tax Key #2161.990.
BE IT FURTHER RESOLVED, That prior to any construction at
said site, a Building, Site and Operation Plan must be
submitted to the Plan Commission for review and approval.
