APPROVAL OF A 10' x 20' SECOND GARAGE FOR
RESOLUTION #P.C. 136-94
JOHN L ROSE MATHY LOCATED AT
567 W13432 FENNIMORE COURT
WHEREAS, A site plan and construction information was
submitted on June 27, 1994 by John & Rose Mathy to construct a
W13432 Fennimore Court, and
10' X 20' second garage structure at the residence located at S67
WHEREAS, The location of the second garage will meet the
setbacks of the RS-2/0PD zoning district and the architectural
appearance would be compatible with the applicant's residence and
surrounding area, and
WHEREAS, The second garage is intended to be used for storage
of boat and trailer, lawn tractor and mower, grill, shovels,
authority to approve the type and size of second garage
rakes, bicycles and snow blower and the Plan Commission has
structures, and
WHEREAS, Materials submitted do not propose the use neither of
this nor any other structure on the property for business related
activities, and
WHEREAS, The petitioner is proposing to construct a 200 square
foot second garage.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of
the second garage, not to exceed 200 square feet, for John L Rose
Mathy subject to the rear setback if at least 15' and the side
yard setback of 20'.
BE IT FURTHER RESOLVED, That subject second garage shall not
be used either for the operation of a business nor the storage of
business related materials and equipment.
BE IT FURTHER RESOLVED, That a building permit is required
prior to construction of subject second garage.
BE IT FURTHER RESOLVED, That a fire wall variance may be
required from the Board of Appeals.
BE IT FURTHER RESOLVED, That failure to comply with the terms
of this resolution and the approved site plans shall result in the
issuance of fines of $100 per day per violation, the initiation of
legal action, or both.
