LANG CONSTRUCTION FOR TED ti LINDA'S COUNTRY SQUIRE LOCATED
AT 572 W16373 JANESVILLE ROAD
WHEREAS, Ted E, Linda's Country Squire is requesting to amend
their building, site and operation plan for the property located
at 572 W16373 Janesville Road, and
WHEREAS, The property is located in a 8-2 Zoning District,
and
WHEREAS, The Plan Commission approved on August 17, 1993,
the Building, Site and Operation Plan was amended to include a
24' x 42' garage to be located on the premises, and
residential area by the addition of a second floor above the
existing residential portion of this property, and
WHEREAS, The petitioner is proposing to expand the
WHEREAS, Residential quarters are a permitted use by
conditional use grant in the B-2 zoning district and by virtue
of Section 4.06 of the Zoning Ordinance, although subject
residential quarters are a non-conforming use, said quarters
appear to be a legal non-conforming use afforded the provision
and protection of an automatic conditional use, and
WHEREAS, Per Section 6.03(2)G. of the Zoning Ordinance it is
within the Plan Commission's authority to grant simple site plan
approval for amendments to conditional uses if the Commission
finds the amendments do not constitute a substantial change or
addition to the existing conditional use.
THEREFORE BE IT RESOLVED, That the Plan Commission approve
the amended Building, Site and Operation Plan and that the site
plan (dated received June 22, 1994) is to be kept on file at the
City of Muskego.
BE IT FURTHER RESOLVED, That a building permit is required
from the Building Department prior to any construction.
