PCR1994100,AIR APPROVAL OF A 16' x 26' SECOND GARAGE FOR RESOLUTION #P.C. 100-94 LOCATED AT S72 W13593 WOODS ROAD LYLE BL WHEREAS, A site plan and construction information was submitted on April 29, 1994 by Lyle Blair to construct a 16' X 26' pole shed at the residence located at S72 W13593 Woods Road, and WHEREAS, The location of the second garage will meet the setbacks of the RS-2 zoning district and the architectural appearance would be compatible with the applicant's residence and surrounding area, and WHEREAS, The second garage is intended to be used for Storage of boat, automobile, and yard equipment and the Plan Commission has authority to approve the type and size of second garage structures, and WHEREAS, Materials submitted do not propose the use neither of this nor any other structure on the property for business related activities, and WHEREAS, The petitioner is proposing to construct a 676 square foot second garage. THEREFORE BE IT RESOLVED, That the Plan Commission approves of the second garage, not to exceed 676 square feet, for Lyle Blair. BE IT FURTHER RESOLVED, That subject second garage shall not be used either for the operation of a business nor the storage of business related materials and equipment. BE IT FURTHER RESOLVED, That a building permit is required prior to construction of subject second garage. BE IT FURTHER RESOLVED, That a fire wall variance may be required from the Board of Appeals. BE IT FURTHER RESOLVED, That failure to comply with the terms of this resolution and the approved site plans shall result in the issuance of fines of $100 per day per violation, the initiation of legal action, or both. (Hillendale Drive and Tyler Drive) 1994, to divide property in the NE 1/4 of Section 18 into ten WHEREAS, A Preliminary Plat was submitted on April 14, rezoning through Resolution #P.C. 139-90, and (10) single family lots and the sketch was approved with the previously approved sketch wherein the lots meet the minimum size and width requirements for the RS-2 Zoning District, and WHEREAS, These lots are a redivision of Lot 5 & Lot 6 by the Plan Commission through Resolution #P.C. 182-91 and the approved through the Final Plat of Wilkinson Estates approved Common Council through Resolution #P.C. 199-92, and WHEREAS, The Preliminary Plat substantially conforms to the THEREFORE BE IT RESOLVED, That the Plan Commission approve the Preliminary Plat for Wilkinson Estates Add'n #1 in the NE 1/4 of Section 18 and will be receptive to a Final Plat subject to the successful resolution of concerns and technical discrepancies as identified in the City Planning Department and City Engineer's comments dated May 4, 1994, and the removal from the lots of all outbuildings.
