PCR1994084AMENDED APPROVAL OF AMENDED BUILDING, SITE AND OPERATION PLAN FOR PARTHENON GYROS & MORE LOCATED AT 575 W17358 JANESVILLE ROAD RESOLUTION #P.C. 84-94 and operation plan for the property located at S75 W17358 Janesville Road, and WHEREAS, Mr. Jifas is requesting to amend the building, site WHEREAS, The property is located in a B-4/0ED Zoning District, and WHEREAS, The Plan Commission approved on March 3, 1993 through Resolution #P.C. 53-93 an amended Building, Site and Operation Plan for this property to allow for the modernization of this building and the Plan Commission took action of Disapproval without Prejudice for an amended Building, Site and Operation Plan for this property through Resolution #P.C. 34-94 and directed Mr. Jifas to petition the Board of Appeals in regards to the issues of an inadequate building street setback and additions to an existing non-conforming structure, and WHEREAS, The Board of Appeals has granted a 9'5" variance from Section 17:8.14(3), 17:9.07(3) and 17:5.02(2)B.l. to allow the construction of a building addition within 17' of the base setback line and a variance from Section 17:4.06(2)A.1. to allow an addition to an existing non-conforming structure, WHEREAS, Through said Appeal #8-94 Mr. Jifas was directed to obtain site plan review and approval from the Plan Commission, and addition to allow for additional seating and work space, and WHEREAS, The petitioner is requesting a 2,579 square foot with issues/concerns discussed in relation to Resolution P.C. 34-94. WHEREAS, The updated site plan is in substantial compliance THEREFORE BE IT RESOLVED, That the Plan Commission approve of the amended building site and operational plan for Parthenon Gyros & More located at 575 W17358 Janesville Road allow a 2,579 square foot addition with the following conditions: 1. Lighting fixtures to be installed shall be of a cut-off type and be limited to fifteen (15) feet in height. 2. Landscaping and fencing shall be installed as approved by the Plan Commission. Landscaping shall be maintained in perpetuity. 3. If occupancy of the addition is requested prior to the installation of landscaping and fencing, a bond or letter of credit for same shall be submitted in an amount equal to twice their value and shall be in the City's favor. Upon their completion, said bond or letter of credit shall be returned. 4. The addition shall conform in color and design to the existing building. 5. All setbacks and offsets shall conform to that which is authorized by the Board of Appeals through Appeal #8-94. 6. Any violation to the conditions of this resolution shall be subject to fines of $100 per day per violation cited. BE IT FURTHER RESOLVED, That a 6' high wood fence be installed along the north property line with a gate across the access to Michi Drive to be locked Monday through Friday from 8:00 a.m. until 4:OO p.m. all year long and making all changes to the proposed landscaping plan as per the Plan Director's recommendation.
