MUNICIPAL CODE OF THE CITY OF MUSKEGO, LAND DIVISION ORDINANCE
RECOMMENDATION TO AMEND CHAPTER 18, SECTION 18:11, OF THE
WHEREAS, The City of Muskego has petitioned to amend Chapter
18, Section 18:11 of the City's Municipal Code, and
WHEREAS, A Common Council Public Hearing has been scheduled
for Tuesday, January 25, 1994, and
WHEREAS, Chapter 18, Section 18:11, Definitions, regulates
the amount of land divisions allowed in the City which reads:
The division of a lot, parcel or tract of land by the owners
thereof or the owner's agent(s) for the purpose of transfer of
ownership or building development where the act of division
creates five (5) or more parcels or building sites of one and
division creates five (5) or more parcels or building sites of
one-half (1-1/2) acres each or less in area; or where the act of
one and one-half (1 1/2) acres each or less in area by
successive division within a period of five (5) years. Other
divisions of land shall be termed "minor land divisions."
This definition shall also apply to the division of a lot,
parcel or tract of land by the owners thereof or the owner's
agent(s) for the purpose of transfer of ownership or building
development where the act of division creates five (5) or more
parcels or building sites of any size by successive division
within a period of five (5) years where dedicated public
improvements are required. For the purpose of this section,
public improvements shall include any one of the following: (1)
sanitary sewer system, (2) water supply system, (3) storm sewer
system, (4) roadways and streets, and

WHEREAS, In the design of commercial and industrial park
configurations may develop until such time as prospective
settings it is often an unknown as to what final parcel
tenant's land requirements are identified, thus possibly
requiring multiple land divisions and parcel reconfigurations
in excess of five (5) parcels of one and one-half (1-1/2) or
more parcels or building sites of one and one-half (1-1/2) acres
less in area; or where the act of division creates five (5) or
each or less in area by successive divisions within a period of
five (5) years.
City of Muskego does hereby recommend that the Common Council
THEREFORE BE IT RESOLVED, That the Plan Commission of the
amend Chapter 18, Section 18:ll (Definitions, Subdivision), Land
Division Ordinance, regulating the amount of land divisions by
adding the following language:
0 The definition of a subdivision shall not apply to
Commercial or Industrial land divisions except to the extent
regulated by the State Law. Other divisions of Commercial or
Industrial land shall be minor land divisions.
BE IT FURTHER RESOLVED, That should the Common Council
approve the amendment, the Municipal Code of the City would be
amended.
