PCR1994010RESOLUTION #P.C. 10-94 DISAPPROVAL OF EXPANSION OF CONDITIONAL USE GRANT AND AMENDED BUILDING, SITE AND OPERATION PLAN TO ALLOWS AN INCREASE IN THE NUMBER OF USED AUTOMOBILES TO 20 AT RONNIE'S MOBILE, S79 W17237 JANESVILLE ROAD WHEREAS, An application was submitted to the Planning Department by Elke Rea of Ronnie's Mobile Service for an expansion of a Conditional Use Grant to allow an increase in the number of used automobiles at an existing gasoline Service station within the 8-3 Zoning District, and sale at any one time and for them to be parked on an existing WHEREAS, It is intended to display 20 used vehicles for parking area located to the east of their present building and on the grassy area behind and to the east of the building, and property have been notified of the Public Hearing, and a Public WHEREAS, The owners of property within 300 feet of this Hearing has been held in conformance with Section 17:3.07 of the City's Code of Ordinances, and approved the expansion of the existing Conditional Use Grant subject to the following conditions: WHEREAS, Through Resolution #P.C. 01-93 the Plan Commission 1. That a maximum of three (3) cars be displayed for sale 2. That the cars be sold only during normal business hours 3. WHEREAS, Through Resolution #P.C. 206-93 the Plan Commission denied the expansion of the existing amended Conditional Use Grant to allow for the sale of 40 used vehicles, and WHEREAS, The Board of Appeals heard a petitioner from Ms. Commission decision regarding the allowable number of cars to Elke Rea .S Mr. Gerald Fohr requesting that the Plan be displayed for sale at this location, be overturned, and 40 cars be permitted. The Board of Appeals denied the request as that a lesser number of cars had been discussed or considered submitted, with the reason being that the Board did not feel by the Plan Commission, and number of vehicles and several of these vehicles are displayed WHEREAS, The petitioner is currently over the allowed on the grassy area. THEREFORE BE IT RESOLVED, That the Plan Commission of the City of Muskego disapprove the request of Elke Rea for the expansion of Conditional Use Grant #56 to allow an increase in the number of used automobiles for display and sale to be 20 at the property located at S75 W17237 Janesville Road.
