APPROVAL OF A 26' x 27' POLE SHED FOR THEODORE LUEDTKE
LOCATED AT S91 W13723 BOXHORN DRIVE
WHEREAS, A site plan and construction information was submitted
on December 13, 1993 by Theodore Luedtke to construct a 26' X 21'
pole shed at the residence located at S91 W13723 Boxhorn Drive, and
WHEREAS, The location of the pole shed will meet the setbacks
of the A-Agriculture zoning district and the architectural
appearance would be compatible with the applicant's residence and
surrounding area, and
horse feed and hay, possible trailer and the Plan Commission has
authority to approve the type and size of second garage structures
(pole shed), and
WHEREAS, The pole shed is intended to be used for horses, tack,
any other structure on the property for business related
activities, and
WHEREAS, Materials submitted do not propose the use of this nor
WHEREAS, The existing outbuilding labeled "Shed 3" on the
submitted site is proposed to be razed.
THEREFORE BE IT RESOLVED, That the Plan Commission approves of
the second garage structure (pole shed), not to exceed 702 square
feet, for Theodore Luedtke.
BE IT FURTHER RESOLVED, That subject garage structure (pole
shed) shall be used neither for the operation of a business or the
storage of business related materials and equipment.
BE IT FURTHER RESOLVED, That a Razing Permit shall be obtained,
and the building identified as "Shed 3" shall be razed within 60
days of the issuance of the occupancy permit for the proposed
garage structure (pole shed).
BE IT FURTHER RESOLVED, That a building permit is required
prior to construction of subject garage structure (pole shed).
BE IT FURTHER RESOLVED, That a fire wall variance may be
required from the Board of Appeals.
BE IT FURTHER RESOLVED, That failure to comply with the terms
of this resolution, and the approved site, building and operation
plans, shall result in the issuance of fines of $100 per day per
violation, the initiation of legal action, or both.
