PCR19932240 RESOLUTION # P.C. 224-93 DISAPPROVAL OF REQUEST FOR A CONDITIONAL USE GRANT TO ALLOW AN EXISTING TAVERN TO BE LOCATED AT S64 W18295 MARTIN DRIVE BY THE EQUITABLE BANK WHEREAS, A petition was submitted to the Planning Department by The Equitable Bank requesting a Conditional Use Grant for an Existing Tavern to be located at 564 W18295 martin Drive, and that this property was zoned "Local Business District" and a "Tavern" was a permitted use. In 1957, the Town of Muskego permitted use making this property a legal nonconforming use, zoning ordinance was revised and a Tavern was no longer a and WHEREAS, In 1955, the Town of Muskego Zoning Map indicated WHEREAS, On May 1983, there was an ordinance interpretation this property, along with all other similar uses throughout the issued by Mr. Gerald Lee, then Building Inspector, stating that City, was granted a blanket Conditional Use Grant sometime after October 15, 1963. 0 THEREFORE BE IT RESOLVED, That the Plan Commission of the City of Muskego does hereby disapprove of the request of The Tavern located at S64 W18295 Martin Drive, and Equitable Bank for a new Conditional Use Grant for an Existing BE IT FURTHER RESOLVED, That this disapproval is based upon the following facts: 1. The proposed use does not constitute an expansion of the existing use and therefore this Conditional Use Grant is not required. 2. The proposed use does not constitute a change in use and therefore this Conditional Use Grant is not required. 3. The proposed use is currently permitted under the authority of a blanket Conditional Use Grant issued sometime after October 15, 1963. 4. The proposed Conditional Use Grant violates current zoning standards in the RS-3/0ED Zoning District as taverns are not a Permitted Use By Conditional Grant (per Sections 17:6.03(3)F.l;, 17:8.08, & 17:9.07).
