PCR1993159AMENDED RESOLUTION # P.C. 159-93 APPROVAL OF REQUEST FOR A CONDITIONAL USE GRANT TO ALLOW THE MULTI-FAMILY USE OF AN EXISTING DWELLING IN AN RS-3/0LS ZONING DISTRICT FOR FREDERICK G. MEYER h JAY STRANDE LOCATED AT W183 S6570 JEWEL CREST DRIVE Department by Mr. Frederick G. Meyer and Mr. Jay Strande WHEREAS, A petition was submitted to the Planning requesting a Conditional Use Grant for the multi-family use of an existing building at W183 S6570 Jewel Crest Drive, and WHEREAS, The City's Code of Ordinances at Section Conditional Uses in the RS-3/0ED/OLS Zoning District if 17:8.01(7) C.ll permits duplexes in existing buildings as approved by the Plan Commission, and District pursuant to the Zoning Ordinance at Section 17:3.04 (4)D regarding offsets and setbacks. WHEREAS, The OLS Zoning District supersedes the OED Zoning WHEREAS, The owners of property within 300 feet of this property have been notified of the Public Hearing and a Public Hearing has been held in conformance with Section 17:3.07 of the City's Code of Ordinances, and WHEREAS, There presently exists a duplex on the property which is granted an automatic Conditional Use Status since the building became a duplex prior to the enactment of the Zoning Ordinance in 1963 and the owner is seeking conditional use status in order officially record the property into conformance with the Zoning Ordinance, and WHEREAS, The regulations provide that a Building, Site and Operation plan be submitted for approval by the Plan Commission petitionner is requesting approval of said Building, Site and in conjunction with the Conditional Use Grant request and the Operation plan. THEREFORE BE IT RESOLVED, That the Plan Commission of the City of Muskego approve the request of Mr. Frederick Meyer h Mr. Jay Strande for a Conditional Use Grant for the multi-family use of an existing building at W183 S6570 Jewel Crest Drive and that the approval be subject to the conditions of Section 17:6.03 of the City's Code of Ordinances. BE IT FURTHER RESOLVED, That the Plan Commission also approves the Building, Site, and Operation plan as required in Section 17:6.03(3)A.2. BE IT FURTHER RESOLVED, That the Conditional Use Permit be recorded with the Waukesha County Register of Deeds which shall include the operational conditions of the grant and reference be kept on file at the City of Muskego. to the approved Building, Site and Operation plan which is to 0 BE IT FURTHER RESOLVED, That the Conditional Use Grant shall be recorded within 30 days of the Plan Commission approval or said approval shall become null and void.
