RECOMMENDATION TO AMEND CHAPTER 14, SECTION 1.5(2),
OF THE MUNICIPAL CODE OF THE CITY OF MUSKEGO,
(LOCATED AT S79 W16130 BAY LANE PLACE)
FLOODPLAIN ZONING ORDINANCE,
WHEREAS, Mr. Rich Raboine has petitioned to amend Chapter
14, Section 1.5(2) of the City's Municipal Code in order to
remove land from the regulated flood hazard area, and
WHEREAS, Chapter NR 116.11(3), Wisconsin Administrative
Code, provides criteria for redelineation or rezoning
floodplain districts, and
WHEREAS, The City of Muskego is requesting an Official
Floodplain Zoning Map Amendment pursuant to NR 116.21 (6), and
where this amendment does not become effective until it has
been approved by the Department of Natural Resources, and
WHEREAS, The Common Council will hold a Public Hearing on
this matter on July 13, 1993, at 7:20 P.M. to consider a
petition to amend said Chapter 14.
NOW THEREFORE, BE IT RESOLVED, That the Plan Commission of
0 Council amend Chapter 14, Section 1.5(2), The Floodplain Zoning
the City of Muskego does hereby recommend that the Common
Ordinance, regarding the Official Floodplain Zoning Map for the
property located at S79 W16130 Bay Lane Place.
BE IT FURTHER RESOLVED, That should the Common Council
City would be amended and the information required by Chapter
approve the amendment to Chapter 14, the Municipal Code of the
NR 116 will be forwarded to the Department of Natural Resources
for their approval and that the change to the Official
Floodplain Map does not become effective until approved by the
Department of Natural Resources.
