PCR1993133RESOLUTION #P.C. 133-93 RECOMMENDATION TO AMEND CHAPTER 14, SECTION 1.5(2), FLOODPLAIN ZONING.ORDINANCE, (UNNAMED TRIBUTARY OF THE MUSKEG0 OF THE MUNICIPAL CODE OF THE CITY OF MUSKEGO, CANAL - PLUM CREEK EAST AND PLUM CREEK ADDITION #1) WHEREAS, The Terra Development Corporation and Carity Land Corporation have petitioned to amend Chapter 14, Section 1.5(2) of the City's Municipal Code in order to remove land from the regulated flood hazard area, and WHEREAS, Chapter NR 116.11(3), Wisconsin Administrative Code, provides criteria for redelineation or rezoning floodplain districts, and WHEREAS, The City of Muskego is requesting an Official Floodplain Zoning Map Amendment pursuant to NR 116.21 (6), and where this amendment does not become effective until it has been approved by the Department of Natural Resources, and this matter on July 13, 1993, at 7:25 P.M. to consider a petition to amend said Chapter 14. WHEREAS, The Common Council will hold a Public Hearing on NOW THEREFORE, BE IT RESOLVED, That the Plan Commission Of the City of Muskego does hereby recommend that the Common Council amend Chapter 14, Section 1.5(2), The Floodplain Zoning Ordinance, regarding the Official Floodplain Zoning Map for the Unnamed Tributary of the Muskego Canal (Plum Creek Addition #1 and Plum Creek East Subdivisions). BE IT FURTHER RESOLVED, That should the Common Council approve the amendment to Chapter 14, the Municipal Code of the City would be amended and the information required by Chapter NR 116 will be forwarded to the Department of Natural Resources for their approval and that the change to the Official Floodplain Map does not become effective until approved by the Department of Natural Resources.
