PCR1993121AMENDED APPROVAL OF REQUEST FOR A CONDITIONAL USE GRANT TO ALLOW A RESOLUTION # P.C. 121-93 VETERINARY CLINIC TO BE LOCATED IN THE MUSKEG0 CENTER (PICK N' SAVE - WALGREENS SHOPPING CENTER) BY MR. C.V. ZILLIG OF C.V. ZILLIG. WHEREAS, A petition was submitted to the Planning Department by Mr. C.V. Zillig requesting a Conditional Use Grant for a Veterinary Clinic to be located in the Muskego Center (Pick N' Save - Walgreens Shopping Center), and WHEREAS, The City's Code of Ordinances at Section 17:8.12(7) C.3 permits animal hospitals as Conditional Uses in the B-2 Zoning District if approved by the Plan Commission, and WHEREAS, The owners of property within 300 feet of this property have been notified of the Public Hearing and a Public Hearing has been held in conformance with Section 17:3.07 of the City's Code of Ordinances, and WHEREAS, The regulations provide that a Building, Site and Operation plan be submitted for approval by the Plan Commission in conjunction with the Conditional Use Grant request and the petitioner is requesting approval of said Building, Site and Operation plan. THEREFORE BE IT RESOLVED, That the Plan Commission of the City of Muskego approve the request of Mr. C.V. Zillig and hereby grant a Conditional Use Grant for a Veterinary Clinic to be located in the Muskego Center (Pick N' Save - Walgreens Shopping Center) and that the approval be subject to the conditions of Section 17:6.03 of the City's Code of Ordinances and also subject to the following conditions: 1. The unit will be required to have adequate ventilation and exhaust fans. 2. All animal waste will be cleaned up immediately with odor This shall include removal of solids and washing down sidewalks counteractive disinfectant from the shopping center property. and the parking area in the immediate vicinity of the front and rear door. 3. No animals will be permitted to be walked or exercised on adjoining properties and will only be walked or exercised on the property line south of the building. and euthanized animals will be placed in cooler/freezers 4. All biological waste will be disposed of in a proper manner until disposal. 5. Interior walls to be sound-proofed in what ever manner nessessary such that adjacent tenents cannot hear noise from the clinic. the Plan Commission after 1 year from the approval date. 6. That a review of the Conditional Use Grant must be done be 7. That the dumpster must be tamper proof. approves the Building, Site, and Operation plan as required in BE IT FURTHER RESOLVED THAT, The Plan Commission also Section 17:6.03(3)A.2. BE IT FURTHER RESOLVED THAT, The Conditional Use Permit be recorded with the Waukesha County Register of Deeds within 30 days of this approval or this approval becomes null and void and which shall include the operational conditions of the grant which is to be kept on file at the City of Muskego. and reference to the approved Building, Site and Operation plan City of Muskego Plan Commission Adopted 06-15-93 Defeated Deferred ,e 06-10-93
