TO ALLOW FOR AN EXISTING 50' X 100' ACCESSORY BUILDING TO BE
APPROVAL OF EXPANSION TO CONDITIONAL USE GRANT #6
AND TO ALLOW SALES OF USED AUTOMOBILES LOCATED AT 583 W20411
JANESVILLE ROAD BY WALTER BOHRER, JR. AND SAM MASLAR
WHEREAS, The Plan Commission of the City of Muskego has
received a petition from Mr. Walter Bohrer, Jr. and Mr. Sam
Maslar for an expansion to existing Conditional Use Grant # 6 to
Merchandising and Wholesale Establishment" and to allow for the
allow a 50' X 100' accessory building to be used for "General
accessory building located at S83 W20411 Janesville Road, and
sales of used automobiles in conjunction to the use of the
USED FOR "GENERAL MERCHANDISING AND WHOLESALE ESTABLISHMENT"
WHEREAS, The owners of property within 300 feet of this
property have been notified of the Public Hearing, and a Public
Hearing has been held in conformance with Section 17:3.07 of the
City's Code of Ordinances, and
WHEREAS, The City's Zoning Ordinance permits the expansion
of a Conditional Use in the RS-2/0HS Zoning District upon the
approval of the Plan Commission, and
Operation plan be submitted for approval by the Plan Commission
petitioner is requesting approval of said Building, Site and
in conjunction with the Conditional Use Grant request and the
Operation plan.
WHEREAS, The regulations provide that a Building, Site and
City of Muskego does hereby grant an expansion to Conditional
THEREFORE BE IT RESOLVED, That the Plan Commission of the
Use Grant #6 to allow a 50' X 100' accessory building to be to
used for a "General Merchandising and Wholesale Establishment"
with the use of the accessory building located at S83 W20411
and and to allow the sales of used automobiles in conjunction
Janesville Road and that the approval be subject to Section
17:6.03 of the City's Code of Ordinances and subject to the
following conditions:
1. The site will have an asphalt or concrete parking lot, which
customer automobiles and the maximum number of fleet cars or
is striped and marked and of sufficient size to accommodate 50
bank repossessions which would be located on the site at any
one time. Said parking lot to have asphalt or concrete by
August 31, 1993.
2. No parking of vehicles along Janesville Road (CTH L ).
3. Automobiles will not be displayed with "For Sale" Signs
except for the minimum required by State Law and hung from the
rear view mirror or window sticker.
e 4. No storage of junk or wrecked autos and no auto repair, auto
detailing or body work shall occur on the premises.
5. No outside storage of any kind shall be permitted.
6. The garbage dumpster shall be screened from view.
7. Restroom facilities for customers shall be provided.
BE IT FURTHER RESOLVED THAT, The Plan Commission also
approves the Building, Site, and Operation plan as required in
Section 17:6.03(3)A.2.
BE IT FURTHER RESOLVED THAT, The Amended Conditional Use
whic,h shall include the operational conditions of the grant and
Permit be recorded with the Waukesha County Register of Deeds
which is to be kept on file at the City of Muskego.
