PCR1993104AMENDED RESOLUTION # P.C. 104-93 APPROVAL OF CERTIFIED SURVEY MAP OF FOUR (4) LOTS BY METROPOLITAN ENGINEERING FOR CHESTER J. & VIRGINIA L. SPITZNER IN THE SW 1/4 OF SECTION 17 WHEREAS, A Certified Survey Map was submitted on May I, 1993, by Metropolitan Engineering for Chester J. h Virginia L. Spitzner for a four (4) lot land division in the SW 1/4 of Section 17, and WHEREAS, The Plan Commission on March 16, 1993 approved a Sketch for a seven (7) lot land division through Resolution #P.C. 56-93 subject to the following: wetlands and shoreland/ wetlands and the proposed boundary of 1. The Preliminary Plat must depict the present location of the wetlands and shoreland/wetlands. 2. Deed Restrictions being placed on Lot 1 stating that Lot 1 is not buildable without a perc test and that Lot 7 is required to have a perc test if the dwelling is to be built beyond 300' of Woods Road but if it is built within 300' of Woods Road then a perc test is not necessary. 3. That no filling of the shoreland/wetlands can occur and that Commission and a City Fill Permit (with erosion control plan) be approval from the U.S. Army Corps of Engineers, the Planning obtained prior to filling the wetlands., and Certified Survey Maps rather than through Platting, and WHEREAS, The proposal is now to divide the land via two WHEREAS, The four lots meet the lot size and width requirements of RS-2 Suburban Residence and A-Agricultural Zoning Districts, and wetlands and the Plan Commission granted approval to fill the WHEREAS, The property contains wetlands and shoreland/ first 200 feet of wetlands adjacent to Woods Road through Resolution #P.C. 43-91, and WHEREAS, The lots would have access off of Woods Road with municipal water and sewer provided, and WHEREAS, The lots fronting along Woods Road are within the sanitary sewer service area and the rear of the property lies development of only those lots within the sewer service area, outside the sanitary sewer service area. This would allow the that are able to connect to the system, at this time, and Lot 1 subject to an approved perc test. THEREFORE BE IT RESOLVED, That the Plan Commission approve the Certified Survey Map for the Spitzner Property located in depicting the present location of wetlands and shoreland/ the SW 1/4 of Section 17 subject to the Certified Survey Map wetlands and the proposed boundary of the wetlands and shoreland/wetlands, subject to Deed Restrictions or note on the face of the Certified Survey Map stating that Lot 4 is not further dividable or buildable without a perc test. the Certified Survey Map stating that no filling of the shoreland/wetlands can occur and that approval from the U.S. Army Corps of Engineers, the Planning Commission and a City Fill Permit (with erosion control plan) be obtained prior to filling the wetlands. BE IT FURTHER RESOLVED, That a note be placed on the face of BE IT FURTHER RESOLVED, That the Plan Commission approve the Certified Survey Map for a four (4) parcel land division in the SW 1/4 of Section 17 by Metropolitan Engineering for Chester J. & Virginia L. Spitzner and recommend approval to the Common Council subject to approval of the City Engineer and payment of all applicable fees in Section 10 of the Land Division Ordinance.
