PCR1993073AMENDED APPROVAL OF LEGAL LOT STATUS FOR THE DEANGELIS PROPERTY RESOLUTION #P.C. 73-93 LOCATED AT S64 W18874 & S64 W18868 SCHOOL DRIVE owner of land at S64 W18874 & S64 W18868 School Drive for a determination of legal lot status for the above mentioned parcel, and WHEREAS, A request has been submitted by Paul DeAngelis Sr. approved through Resolution #P.C. 233-92 and by Common Council WHEREAS, A Certified Survey Map for this property was Resolution #286-92 (which has not been recorded) creating two parcels with shared access off of School Drive or one access off of School Drive and another off of Gold Drive if permitted by the Wisconsin DNR, and WHEREAS, The property is zoned RS-3/0ED and RS-3/0LS and the both the OLS Lakeshore District and the OED Existing Development Zoning Ordinance states "where a parcel of land is located in District, only the regulations of the OLS district shall apply, and WHEREAS, The petitioner has agreed to provide an easement to the Muskego Lake Land Conservation, and WHEREAS, If Lot 35 of Mill Valley Unrecorded is granted legal lot status then the portion facing School Drive would rear would retain the RS-3/0LS Zoning, and revert to the RS-3/0ED Zoning District and the remainder to the WHEREAS, If approved, Lot 35 will be 60' X 209' which is approximately 12,540 square feet which meets the minimum lot size of the RS-3/0ED however the lot would be substandard in width at 80% of the required width (75' is required) and the would meet the lot size and width requirements of the RS-3/0LS other lot would contain approximately 81,682 square feet and district, and Gold Drive with the availability of sewer service from School Drive for one lot and from Gold Drive for the larger lot, and WHEREAS The property has direct access to School Drive and WHEREAS, Lots adjoining to the property and in the immediate area are the same general size. THEREFORE BE IT RESOLVED, That the Plan Commission recommend approval for legal lot status for the property located at S64 W18874 & S64 W18868 School Drive for Paul DeAngelis subject to obtaining approval from the Wisconsin Department of Natural of Gold Drive out of the Floodplain.
