APPROVAL OF SKETCH FOR LAND DIVISION (SUBDIVISION) FOR THE
RESOLUTION # P.C. 56-93
SPITZNER PROPERTY IN THE SW 1/4 OF SECTION 17 BY
METROPOLITAN ENGINEERING
WHEREAS, A sketch for a Preliminary Plat was submitted on
March 5, 1993, by Metropolitan Engineering to create 7 lots on
west side of Woods Road, and
square feet and 439,028 square feet(10.079 acres) which meet the
WHEREAS, The sketch proposed to create 7 lots between 30,548
lot size requirements of the RS-2 and A-Agriculture Zoning
A-Agriculture, and
Districts and where the property is presently zoned RS-2 and
WHEREAS, The property contains wetlands and shoreland/
wetlands and the Plan Commission granted approval to fill the
Resolution #P.C. 43-91, and
first 200 feet of wetlands adjacent to Woods Road through
WHEREAS, The lots would have access off of Woods Road with
municipal water and sewer provided, and
WHEREAS, The lots fronting along Woods Road are within the
sanitary sewer service area and the rear of the property lies
outside the sanitary sewer service area. This would allow the
development of only those lots within the sewer service area,
that are able to connect to the system, at this time, and the
remainder two lots subject to approved perc tests.
THEREFORE BE IT RESOLVED, That the Plan Commission approve
the sketch for a Preliminary Plat for the Spitzner Property
Plat depicting the present location of wetlands and shoreland/
located in the SW 1/4 of Section 17 subject to the Preliminary
wetlands and the proposed boundary of the wetlands and
shoreland/wetlands, subject to Deed Restrictions stating that
Lot 1 is not buildable without a perc test and that Lot 7 is
required to have a perc test if the dwelling is to be built
beyond 300' of Woods Road but if it is built within 300' of
Woods Road then a perc test is not necessary.
BE IT FURTHER RESOLVED, That no filling of the
shoreland/wetlands can occur and that approval from the U.S.
Army Corps of Engineers, the Planning Commission and a City
Fill Permit (with erosion control plan) be obtained prior to
filling the wetlands.
BE IT FURTHER RESOLVED, That favorable perc tests for lots
1 and 7 must be obtained prior to approval the a Preliminary
Plat.
