PCR1992274AMENDED RECOMMENDATION OF THE PLAN COMMISSION ON THE PROPOSED AMENDMENT RESOLUTION # P.C. 214-92 TO SECTION 18:2.6 OF THE LAND DIVISION ORDINANCE (FLOODLANDS) WHEREAS, The Common Council directed the Rules, Laws, and Ordinance Committee to review Section 18:2.6 of the City's Land Division Ordinance relating to minimum lot sizes where Floodlands are present, and WHEREAS, The Plan Commission is also responsible for making recommendations to the Common Council on amendments to the Zoning Ordinance and the Land Division Ordinance, and WHEREAS, The following amendment has been recommended by the Rules, Laws, and Ordinances Committee where additions are underlined, deletions are marked with an eversfrike as follows: 2.6 LAND SUITABILITY No Land shall be subdivided for any use which is determined to - be hefd unsuitable for - such a prepeaed use by the City Plan Commission, upon the recommendation of the City Enqineer or any other aqency as determined by the City Plan Commission, for reason of flooding, inadequate drainage, adverse soil or rock formations with severe limitations for development, severe erosion potential, unfavorable topography, inadequate water supply or sewage disposal capabilities, or any other feature likely to be harmful to the health, safety, or welfare of the future residents of the proposed subdivision or of the City. addition: 0 or mound system shall contain not less than 40,000 square feet of land which is at an elevation at least two (2) feet above the elevation of the one hundred (100) year recurrence interval flood or, where such data is not available five (5) feet above the elevation of the maximum flood of record. recommend approval to the Common Council that the above stated THEREFORE BE IT RESOLVED, That the Plan Commission amendment of the Land Division Ordinance be considered at a Common Council Public Hearing. BE IT FURTHER RESOLVED, That the Common Council also consider changing the two references to "five (5) feet above the elevation of the maximum flood of record" to "two (2) feet above the Ordinary Hiqh Water Mark".
