APPROVAL OF FINAL PLAT AND DEED RESTRICTIONS FOR PLUM CREEK
SUBDIVISION IN THE SW 1/4 OF SECTION 17 (WOODS RD)
WHEREAS, A Preliminary Plat for 231 lots was approved on
July 7, 1992 through Resolution #P.C. 149-92 and the Preliminary
Plat was approved by the Common Council through Resolution
#182-92, and
WHEREAS, A Sketch for a revised Preliminary Plat was
approved through Resolution #P.C. 207-92 which did not contain
any revisions to the first phase and the Final Plat consisting
of 52 lots substantially conforms to the Preliminary Plat
and the revised Sketch, and
WHEREAS, The Waukesha County Park and Planning Commission
has responded to the plat with a Conditional Certification of No
Objection with two remarks; 1. Woods Rd. and the interior
subdivision streets must be labeled on the face of the Final
plat, and 2. That the standard basement groundwater restriction
statement be placed on the face of the Final Plat, and
Trade and Consumer Protection has not yet certified the plat as
WHEREAS, The State of Wisconsin, Department of Agriculture,
non-objectional, and
WHEREAS, In order to ensure that the proposed development is
consistent in all respects to the spirit and intent of Chapter
17 (Zoning Regulations), Section 6.02 (5) B (Planned Development
Projects) of the City's Code of Ordinances, the City's Plan
Commission exercises its authority to review the deed
restrictions for Plum Creek, and
WHEREAS, The deed restrictions provide for certain minimum
building requirements and site improvements and these
requirements do conform with the intent of Section 17 6.02 (3) B
of the City's Code of Ordinances which allows individual uses
and structures to vary in the specific building location,
height, building size, lot size, and open space requirements of
the underlying zoning district.
THEREFORE BE IT RESOLVED, That the Plan Commission of the
City of Muskego approve the Deed Restrictions for the Plum Creek
Subdivision and the Final Plat subject to the two
recommendations of the Waukesha County Park and Planning
Commission, the remaining objecting agencies concerns, the City
Engineer's review dated October 21, 1992, payment of all
applicable subdivision fees, and approval of Subdivider's
Agreement and Letter of Credit.
