RECOMMENDATION TO REZONE WETLANDS FROM RS-2 TO SW IN THE NW 1/4
RESOLUTION #P.C. 165-92
OF SECTION 12 (S74 W13450 COURTLAND LANE - ED DUKLAS PROPERTY)
acre of wetlands in an area zoned as RS-2 on the City's Official
WHEREAS, Ed Duklas requested to continue to fill one (1)
Zoning Map and Mr. Duklas has filled the property and therefore
Plan Commission review is unnecessary, and
WHEREAS, The City's Official Zoning Map, the Southeastern
Wisconsin Regional Planning Commission's interpretation of
aerial photos, and the Wisconsin Wetland Inventory Maps (revised
or Shoreland-Wetlands and based on that information the City
3-13-86) have not previously designated the lands to be wetlands
approved these lands to be filled, and
WHEREAS, Upon field investigation by the U.S. Army Corps of
Engineers and the Wisconsin Department of Natural Resources the
lands were determined to contain wetlands with another portion
determined to be Shoreland-Wetlands and the U.S. Army Corps of
Engineers granted approval under a Nationwide Permit to fill one
(1) acre of wetlands, and
0 requested that the remainder of Mr. Duklas's property up to the
WHEREAS, The Wisconsin Department of Natural Resources has
drainage ditch be rezoned Shoreland-Wetlands in order to prevent
future filling activity adjacent to a navigable waterway.
THEREFORE BE IT RESOLVED, That the Plan Commission of the
City of Muskego during its consideration of the Comprehensive
Land Use Plan and subsequent Comprehensive Rezoning recommend to
the Common Council that the remainder of Mr. Duklas's property
defined as Shoreland-Wetlands be rezoned to Shoreland-Wetlands
consistent with Chapter NR 117, Wisconsin Administrative Code.
BE IT FURTHER RESOLVED, That the filling of
Shoreland-Wetlands is not permitted and that the City will
wetlands in the'courtland Lane area.
