MUNICIPAL CODE OF THE CITY OF MUSKEGO, FLOODPLAIN.ZONING
ORDINANCE
January 3, 1992 assigned a Hazard Rating Class 3, High Hazard,
WHEREAS, The Wisconsin Department of Natural Resources on
for the Little Muskego Lake Dam and required the City to zone
the area to prevent further development; and
mean applying floodplain ordinances to lands within the
hydraulic shadow of the dam downstream; and
WHEREAS, Wisconsin DNR has interpreted that requirement to
WHEREAS, The Hazard Rating was based on a study prepared by
the City Engineer: and
WHEREAS, Chapter NR 116.05(4), Wisconsin Administrative
Code, requires that within six months from the time new study
Municipality shall upgrade its Floodplain Zoning Ordinance; and
data is available to a municipality by the DNR, the
WHEREAS, The City's Floodplain Zoning Ordinance is
contained in Chapter 14 of the Municipal Code and should be
amended to comply with the reauirements of ChaDter NR 116 and

WHEREAS, The Common Council through Resolution #135-92
filed a petition to amend said Chapter 14, and
WHEREAS, Many property owners have complained of the effect
of this zoning change on their property.
NOW, THEREFORE, BE IT RESOLVED, That the Plan Commission of
the City of Muskego does hereby reluctantly recommend to the
Common Council the amendment of Chapter 14, Section 1.5(2), The
Floodplain Zoning Ordinance, regarding the official floodplain
zoning map for the area south of the Little Muskego Lake Dam as
shown on the map on file with the City known as Dam Failure
Flooding Limits, per the order of the Wisconsin Department of
Natural Resources.

BE IT FURTHER RESOLVED, That should the Common Council
