PCR1992111REINSTATEMENT OF ZONING FOR STONEY CREEK RETIREMENT RESOLUTION P.C. #111-92 COMMUNITY FROM RS-2 TO RSM/OPD IN THE SE 1/4 OF SECTION 2 FROM RS-2 TO RSM/OPD BY ART THIEDE AMENDED WHEREAS, The Common Council approved Resolution #277-89 which Indicated the City's Present Intent to Approve the Concept of RSM/OPD Zoning for Lutherans Inc. for Elderly (L.I.F.E.) and sunsequently rezoned the property from RS-2 to April 18, 1991, and RSM/OPD through Ordinance #709 which became effective on WHEREAS, A condition of Ordinance #709 was that "The construction of the development has begun on or before one year from the date of this Ordinance:", and Ordinance #709 stated that "This ordinance shall be in full WHEREAS, This condition was not met and Section 3 of force and effect from and after its passage and publication but stated, this Ordinance is null and void and the RS-2 zoning if said condition stated above is not met within the time limit is in full force and effect", and WHEREAS, A petition has been filed by Mr. Art Thiede to amend the Official Zoning Map of the City of Muskego from RS-2 to RSM/OPD for the purpose of reinstating the RSM/OPD zoning. THEREFORE BE IT RESOLVED, That the Plan Commission recommend approval for the rezoning of this property located in the SE 1/4 of Section 2 from RS-2 to RSM/OPD (Tess Corners Drive). BE IT FURTHER RESOLVED, That should the Common Council approve the rezoning of the property to RSM/OPD, the Official Zoning Map of the City would be amended. BE IT FURTHER RESOLVED, That the construction of the development begin on or before one year from the date of the Common Council Ordinance approval.
