PCR1992104APPROVAL OF A CONCEPT FOR A CONDITIONAL USE GRANT FOR KWIK RESOLUTION #P.C. 104-92 TRIP, INC. TO LOCATE A CONVENIENCE STORE WITH MODERN FUELING AND JANESVILLE ROAD WITHIN AN OUTLOT OF THE PROPOSED TERRA EQUIPMENT AND CANOPY ON THE NORTHWEST CORNER OF RACINE AVENUE DEVELOPMENT RETAIL MALL IN THE NE 1/4 OF SECTION 17 AMENDED WHEREAS, A petition and a building, site and operation plan was submitted to the Planning Department by Paul Hansen of Kwik Trip Inc. requesting a Conditional Use Permit for a convenience store with fueling equipment within an outlot of the proposed Terra Development retail mall at the NW corner of Racine Avenue and Janesville Road, and WHEREAS, Said outlot does not presently exist via Certified Survey Map, and ~ WHEREAS, The City's Code of Ordinances at Section 17:8.11 District as conditional uses in the E-2 Zoning District if (7) C. 1 permits gasoline service stations per the E-1 Zoning approved by the Plan Commission, and ! WHEREAS, The owner5 of property within 300 feet of this property have been notified of the public hearing and a public hearing has been held in conformance with Section 17:3.07 of the City's Code of Ordinances, and WHEREAS, The regulations provide that a building, site and upon the approval of the Conditional Use Permit and the operation plan be submitted for approval by the Plan Commission applicant has submitted the required building, site and operation plan. THEREFORE BE IT RESOLVEDl That the Plan Commission of the City of Muskego gives Kwik Trip the knowledge that the Plan Commission approves the concept of a Conditional Use Permit for a convenience store, being located at the intersection of Racine and Janesville with modern fueling equipment.
