PCR19920730 RESOLUTION #P.C. 73-92 APPROVAL OF CERTIFIED SURVEY MAP FOR LOWELL PETERSON IN THE NW 1/4 OF SECTION 11 (WOODS ROAD) 1992, to divide land into two lots in the NW 1/4 of Section 11 on WHEREAS, A certified survey map was submitted on March 27, the south side of Woods Road by Lowell Peterson, and requirement of 20,000 square feet and a minimum average width requirement of 110 feet, and WHEREAS, The property is zoned RS-2 with a minimum lot size WHEREAS, The lots would be served by sanitary sewer, and WHEREAS, A sketch detailing this land division was disapproved by the Plan Commission through Resolution #P.C. 229-91 on January 21, 1992 because the land division would create nonconforming lots in terms of substandard size and minimum average width, and Board of Appeals which granted variances for lot size and minimum average width with the hardship being an unreasonable road dedication and stipulated that all future buildings would have to conform to the legal offsets and setbacks, and WHEREAS, The Plan Commission disapproval was overturned by the the previously disapproved sketch and contains the required road WHEREAS, The Certified Survey Map substantially conforms with dedication previously imposed by the Plan Commission. THEREFORE BE IT RESOLVED, That the Plan Commission approve the certified survey map for Lowell Peterson in the NW 1/4 of Section 11 and recommend approval to the Common Council subject to approval of the city engineers and payment of all applicable fees in Section 10 of the Land Division Ordinance.
