PCR1992028APPROVAL OF CONDITIONAL USE GRANT TO PERMIT A DAY CARE CENTER RESOLUTION #P.C. 28-92 5103 W19123 KELSEY DRIVE FOR SANDRA K. BAUMBACH AMENDED WHEREAS, An application was submitted to the Planning Department by Sandra K. Baumbach for a licensed "group day care center" in the lower level of their home at S103 W19123 Kelsey Drive which requires a Conditional Use Permit within the R-1 Zoning District, and WHEREAS, The "group day care center" is proposed for the lower children and operate between the hours of 6:OO A.M. and 6:OO P.M level of the home in an "exposed basement" and serve up to 20 to 30 and is required to obtain a state license, and WHEREAS, Floor plans and a parking plan have been submitted that indicate that the day care facility will have a total of 1,200 square feet of enclosed area and consist of a general purpose area, an infant room, an art and dining area, a kitchen, washroom facilities, and an equipment room. Also proposed is an outside play area and a parking area for seven (7) automobiles, and WHEREAS, The owners of property within 300 feet of this property have been notified of the public hearing, and a public City's Code of Ordinances, and hearing has been held in conformance with Section 17:3.07 of the WHEREAS, The City's zoning ordinance permits this type of use as a Conditional Use in the R-1 zoning district upon the approval of the Plan Commission, and guidelines for the placement and operation of such facilities other than those imposed by the Plan Commission through a Conditional Use Permit. WHEREAS, The City's Code of Ordinances do not provide specific THEREFORE BE IT RESOLVED, That the Plan Commission Of the City of Muskego approve the request of Sandra Baumbach to operate a State of Wisconsin licensed "group day care center" in their home at S103 W19123 Kelsey Drive as a Conditional Use within the R-1 Zoning District and that the approval be subject to the conditions set forth below: (10) be at the facility at any one time (including the four (4) 1.
