PCR1992020AAPPROVAL OF SKETCH FOR LAND DIVISION IN THE SW 1/4 AND NW 1/4 RESOLUTION #P.C. 20-92A OF SECTION 26 - JOSEPH SMUKOWSKI WHEREAS, A sketch was submitted on January 23, 1992 for a land division for two (2) lots at W152 S9832 Thode Drive for the Smukowski Farm and the Plan Commission disapproved the proposed sketch at their meeting on February 4th, 1992 and required the applicant to revise the sketch, and minimum lot size of 120,000 square feet and a minimum average width WHEREAS, This land is zoned A - Agriculture which requires a of 300 feet and the proposed lots now meet these minimum requirements, and road right-of-way which meets the requirements of the Land Division WHEREAS, Access for the lots are to be from a 60 foot dedicated Ordinance, and WHEREAS, Soil borings have been conducted for the proposed lots which indicate that the soils are suitable for mound systems. NOW THEREFORE BE IT RESOLVED, That the Plan Commission of the City of Muskego approve the sketch for two land divisions in Section 26 at the end of Thode Drive and will be receptive to the submittal of Certified Survey Maps for the two parcels. BE IT FURTHER RESOLVED, That the Certified Survey Maps will be prepared in conformance with the Land Division Ordinance and that the Certified Survey Maps contain notes that read: - The Public Works Superintendent shall determine if the existing Cul-de-sac be relocated further to the north along the proposed dedication at such time the improvements are made to the extension of Thode Drive. (for lot along Thode Drive extension only) - No City maintenance of the dedicated Right-of-way will be provided until the Right-of-way is improved to City standards. - The proportionate cost of the improvements necessary to bring the Right-of-way up to City street standards will be borne by the property owners benefiting from the improvements. City of Muskego Plan Commission Adopted I' Defeated Deferred ljk 2/13/92 DISAPPROVAL OF SKETCH FOR LAND DIVISION IN THE SW AND NW 1/4 OF RESOLUTION #P.C. 20-92 SECTION 26 - JOSEPH SMUXOWSKI WHEREAS, A sketch was submitted on January 23, 1992 for a land division for two (2) lots at W152 59832 Thode Drive for the Smukowski Farm, and minimum of 120,000 square feet and a minimum average width of 300 width (one (1) lot is shown as 182.5 and the other lot is shown as feet and neither of the proposed lots meet the minimum average 235 feet, and WHEREAS, This land is zoned A - Agriculture which requires a WHEREAS, Access for one of the lots is to be from a 30 foot private drive which is not in conformance with the access requirements of the Land Division Ordinances and the other lot is to access off of the proposed extension of Thode Drive and does meet the requirements of the Land Division Ordinance, and WHEREAS, Soil borings have been conducted for the proposed lot which indicate that the soils are suitable for mound systems, and definition of a subdivision in Section 11.0 and is as follows: "The division of land by the owner or subdivider resulting in the creation of not more than four (4) parcels or building sites or the division of a block, lot or outlot within a recorded subdivision plat into not more than four (4) parcels or building sites without changing the exterior boundaries of said block, lot or outlot", and WHEREAS, The City's Land Division Ordinance provides a WHEREAS, The City's regulations are more restrictive than Chapter 236, Wisconsin Statutes, Section 236.02 (12), and WHEREAS, The proposed land division is not in conformance with Section 18.11.0 of the City's Code of Ordinances because the land division would create more than six parcels or building sites. NOW THEREFORE BE IT RESOLVED, That the Plan Commission of the City of Muskego disapprove the sketch for further land divisions in Section 26 excepting those found in Resolutions. #P.C. 21-92 and 22-92.
