PCR1992001RECOMMENDATION FOR DISAPPROVAL TO REZONE PROPERTY IN THE NW 1/4 OF RESOLUTION #P.C. 1-92 SECTION 2 FROM RS-1 TO B-1 TO ALLOW A RESIDENTIAL HOME AND A SIGN SHOP BUSINESS FOR WAYNE HOLLENSTEIN Map of the City of Muskego for the property located at 6300 Tess Corners Road from RS-1 to B-1, and WHEREAS, A petition has been filed to amend the Official Zoning WHEREAS, Upon favorable approval by the Common Council the applicant will seek a Conditional Use Permit from the Plan Commission to allow a sign shop to be located in conjunction with the residence, and WHEREAS, The rezoning of a singular parcel of land to allow a use other than residential would allow a special advantage to the parcel and would constitute spot zoning, and which is an established residential area consisting of 12 WHEREAS, The parcel is on the west side of Tess Corners Road residences and two commercial enterprises. The commercial uses are located nearer to Janesville Road. The area on the east side of Tess Corners Road consists of commercial and industrial uses, and WHEREAS, A more appropriate zoning for this site is RS-l/OOS which requires that the underlying zoning district regulations on the design and layout of the proposed use consistent with the surounding residential area, and remain in effect and which would provide the City with more control WHEREAS, Upon approval of the rezoning by the Common Council, the developer will submit a site plan for the proposed project subject to the review and approval of the Plan Commission. THEREFORE BE IT RESOLVED, That the Plan Commission recommends that the zoning be changed from RS-1 to RS-l/OOS rather than B-1 and that upon the approval of the Common Council the Official and approval of the Plan Commission and that the use be limited to Zoning Map be amended and a site plan be submitted for the review a sign shop and a single family residence. Should the ownership of the property change and a use is contemplated other than which is permitted within the RS-1 or 00s districts, a revised site and operation plan is required.
