PCR1991241APPROVAL OF CERTIFIED SURVEY MAP TO REDIVIDE PARCEL 1 PARCEL 3 CERTIFIED SURVEY MAP 6296 AND VACATED ROAD, TO CREATE PARCEL 2 OF CERTIFIED SURVEY MAP 6287 AND PARCEL 1 AND PARCEL 2 OF RESOLUTION #P.C. 241-91 AND OUTLOT 1 LOCATED IN THE SE 1/4 OF SECTION 9 J.C. DEVELOPMENT AMENDED WHEREAS, A certified survey map was submitted on 12-11-91 to redivide parcels 1 and 3 of Certified Survey Map 6281 and parcels 1 and 2 of Certified Survey Map 6296 and vacated road in order to create parcel 2 and outlot 1, and WHEREAS, The remaining parcels all conform with square .footage and minimum lot width requirements of the RS-3/B-2/OPD zoning districts, with the exception of outlot 1, which will be redescribed to parcel 1 of Certified Survey Map 5693 in the future, and WHEREAS, The Plan Commission is receptive to the combining of this outlot with the existing parcel 1 of Certified Survey Map 5693, and 0 WHEREAS, Resolution #P.C. 228-91 approved the rezoning of the newly created Parcel 2 as RS-3/B-Z/OIP, and WHEREAS, The existing building on Parcel 3 conforms with zoning requirements regarding offsets and setbacks, and WHEREAS, The City notes that the current driveway for parcels 1 and 2 of Certified Survey Map 6269 crosses the proposed parcel 1 without benefit of an ingress egress easement, and WHEREAS, The city engineers have reviewed the certified survey map, and and WHEREAS, Easements will be provided for all public utilities, THEREFORE BE IT RESOLVED, That the Plan Commission approve the redivision of parcels 1 and 3 of Certified Survey Map 6287 and parcels 1 and 2 of Certified Survey Map 6296 and vacated road in order to create parcel 2 and outlot 1 located in the SE 1/4 Of payment of all applicable fees in Section 10 of the Land Division Ordinance, subject to the city engineer's requirements being met- Section 9, and recommend approval to the Common Council subject to THEREFORE BE IT FURTHER RESOLVED, That the City notes that the current driveway for parcels 1 and 2 of Certified Survey Map 6269 crosses the proposed parcel 1 without benefit of an ingress egress easement, and if no easement is provided in the future, that in the event that the driveway must be moved in the future that it will be done at the expense of the owners of parcels 1 and 2 of Certified Survey Map 6269, and at no expense to the City.
