PCR1991230APPROVAL TO CONSTRUCT A POND AMENDED RESOLUTION #P.C. 230-91 FOR DYER/BARRETT AT W208 S8903 HILLENDALE Hillendale was approved in Resolution #P.C. 9-90 and Common Council Resolution #124-91, and WHEREAS, A plan for the construction of a pond at W208 58903 WHEREAS, The letter of credit expired on 10/1/91, and WHEREAS, The conditions of Common Council Resolution #124 - 91 have not been met, and WHEREAS, At the City Attorney's request the $27,000 in the letter of credit has been deposited with the city, and WHEREAS, This $27,000 was to restore the disturbed areas of the pond and to designate the route of travel, and WHEREAS, The request made by DyerfBarrett does not include the further removal of any clay at W208 Sa903 Hillendale. THEREFORE BE IT RESOLVED, That the Plan Commission approve the Hillendale Drive. request to construct a pond for Dyer/Barrett at W208 58903 BE IT FURTHER RESOLVED, That the approval of the pond is subject to the following conditions: 1. The pond shall be completed in accordance with the approved excavation and grading site plan attached as Exhibit A. 2. The site shall be contoured and seeded by May 31, 1992. 3. The site shall be completely restored by July 31, 1992 and shall be inspected by the City by July 31, 1991 to ensure complete compliance with this Resolution and Exhibit A. 4. Hours of operation shall be from 7:OO A.M. to & days a week. 5.
